Just had a small meeting with ByLaw officer. he told me they don't have the power to shut down the spas. They have to take us to court first and get the judge's order to be able to shut down the spas like they did 20 yrs ago. I don't think the total shut down will happen this time.

She pulled out all her fixtures that she installed. It may have been agreed to with the landlord but it’s not a usual arrangement.
What do these building owners think the use is when they rent the space to these girls will be?

I do not think it was a midnight move. Probably a negotiated move to get out of the lease. Landlord agreed on an early termination with some penalties and she is probably allowed to remove some fixtures.
Pure speculation: She rushed to open the new place at HWY 27/Hwy7. Not sure if there was enough time for permits etc. Probably another case where she had no choice but to pivot to a legit spa.
Anyway it is all working well for her. The Spa is busy every day. Less stressful. I am glad it is working out for her there. Unfortunately, the other location that she was going to open ran into landlord issues. Not sure if it had been resolved yet.

Problem with these building owners - like you said earlier - small landlords are just that - small. They need the income stream. Same with those Real Estate agents who help these spa owners look for a place - commission.

By law officers are notorious for being inflexible wankers. That is why a good business motto has always been never take a no from someone who is never going to say yes. Go over their heads or to court. Never met a by-law officer you could reason with or get to concede a point to evidence or logic, they would just regurgitate their same opinion over and over again.

Interesting note: the BTK killer slaughtered women for a few years sending taunting letters to the authorities then just disappeared, no crimes that fit the MO nor further correspondence. About a decade later he reappeared sending an email taking up his taunting; sadly for him they were able to quickly trace the email to a public library and were quickly able to figure out his identity and arrest him. But what was he doing all those years he was inactive?

Turns out he was a municipal by-law officer. Most serial killers have trouble giving up the thrill, but being in petty enforcement he was able to continue being sadistic, lording it over victims, and domineering others according to his own will.

Yes, as I said earlier they cannot shut anyone down. But what they can do is to make it very hard to operate. IF they target you, then you are going to get regular visits, numerous violiation tickets etc. For them to go to court to get a court order to shut you down is a lot of work on their part. But they will make you go to court to fight these tickets. It takes a lot of your time, energy and money to do that.

One other issue being overlooked is zoning violiation. If that unit is not zone for use as a "Wellness Centre" then they can now target the landlord to apply. Earlier someone mentined fines of $50,000 for zoning violiations.

Another avenue the Bylaw has is of fines are not paid, the outstanding amount can get applied to the property via their property taxes. Not sure if licensing violations would apply but if they did then the landlord would get involved.

They can shut down any business that's in violation of by laws. It is within their power, however, its not something they can do right away.

In the end as mentioned above, they don't even need to go to that extent, just harass the crap out of the business till they can't take it anymore.

What makes you think the landlord wasn't fully aware of what she was going to do there?

I have dealt with so many Bylaw officers, most of them are real nice guys and very reasonable so long as you talk nice , polite and show respect to them. If you act like a dick and threw fake lic at them, they know everything and they'll come after your ass.

it's not about nice or nasty officer,even you talk nice they got to do their job.So every spa in RH will need body rub lincence and belive they know what spa provide with legit or "extra" service

You know what makes this whole mess very unsettling for these owners. The uncertainly of it all.

What are my rights.
Am I going to get a visit by Bylaw today.
With all of this going on, are my regulars staying away. Would I even get any customers.

Yeah feels this way. Even based on above comments it sounds like bylaw officers are still dropping by EBC these days too.
